Unleashed Dogs

2/19/2013

We are having problems with unleashed dogs running loose in the village.

Our deed restrictions state the following:

8. ANNOYANCE OR NUISANCES – No noxious or offensive activity shall be carried on upon any lot nor shall anything be done thereon which may be, or become, an annoyance or nuisance to the neighborhood. No animals, livestock, or poultry of any kind shall be raised, bred or kept on any lot except dogs, cats or other common household pets, provided they are not kept, bred or maintained for commercial purposes or in unreasonable numbers. All animals or pet must be leashed or restrained within an adequate enclosure. Notwithstanding the foregoing, no animals or fowl may be kept on the property which results in an annoyance or are obnoxious to residents in the vicinity.

The City of Houston Ordinance states:

DIVISION 3 – IMPOUNDMENT OF DOGS RUNNING AT LARGE

Sec. 6-101 – Running at large prohibited.

It shall be unlawful for any person owning or having in his possession any dog to allow such dog to be at large without the owner or person in charge thereof having direct physical control over such dog. An owner or person having in his possession a dog may allow the dog to be at large on property that does not provide the animal with access to a sidewalk or street.

It shall be unlawful for any person owning or having in his possession a dangerous dog, as defined in section 6-151 of this Code, to allow that dog to be at large. A person who violates this subsection shall, upon conviction, be assessed a fine of not less than $500.00 nor more than $2,000.00. Each day that any violation of this subsection continues shall constitute and be punishable as a separate offense.

The Board of Directors encourages each resident to comply with the covenants of the village and the City of Houston Ordinance.
